    Well in CA instead of assault it is mayhem
    CALIFORNIA CODES
    PENAL CODE
    SECTION 203-206.1

    203. Every person who unlawfully and maliciously deprives a human
    being of a member of his body, or disables, disfigures, or renders it
    useless, or cuts or disables the tongue, or puts out an eye, or
    slits the nose, ear, or lip, is guilty of mayhem.

    205. A person is guilty of aggravated mayhem when he or she
    unlawfully, under circumstances manifesting extreme indifference to
    the physical or psychological well-being of another person,
    intentionally causes permanent disability or disfigurement of another
    human being or deprives a human being of a limb, organ, or member of
    his or her body. For purposes of this section, it is not necessary
    to prove an intent to kill. Aggravated mayhem is a felony punishable
    by imprisonment in the state prison for life with the possibility of
    parole.

    The law here states you can do anything you fucking like if you are in such danger that it was the only option you had open.

    Conversely if you tickled a stranger on the street for no reason they could arguably file assault charges.

    Since you are in the US are you suggesting that in a country where lethal force against an intruder in your home is acceptable, eye gouging them for raping you isn't?

    This is pretty damn funny to me, because the thought of living in a place where they felt the particular need to ban eye gouges in of them selves(most likely as a result of a string of eye gouging) doesn't sound like a good place to live. The worse part is that there probably is a place that specifically does have a law against eye gouging just by virtue of all the silly freaking laws around especially arcane laws the have been carried over.
