      Incidentally, the government has been involved in marriage since long before the 19th century all around the world. Roman laws for example define marriage very clearly and that was 500ish BC.

      The problem isn't in the government's interest in marriage. Because the interest is valid at least for some facets of it, like recognition of estate claims, tax benefit issues, military benefits etc. The problem is at least in the U.S. is that the government has failed to keep the separation of church and state coherent.

      It is because of this that laws prohibiting gay marriage last/lasted as long as they did. Marriage as the government sees it and defines it has nothing to do with how the church sees it and defines it. So while the government really has no business telling people who they can and can't marry (as long as both parties have legal status to sign documents I suppose), it isn't realistic to have them stay out of the marriage business entirely.

          Marriage between two people of alternative sexual orientations is much longer and harder to say. Personally, I would prefer to just say marriage. Just like I don't go to hang out with my gay friend and have some gay vodka and play some gay cards. But then, nobody would know what I am talking about.

          The Legislature passes a law to legalize marriage??

            Same sex marriage or homosexual marriage.

              I wrote homosexual, but then I second guessed myself and thought that I misspelled it. I was writing on my kindle, and the spell check thing is weird. So I just said, screw it and changed it to gay marriage.

                      We had a lawsuit here in Germany.
                      Someone called a LEO a homosexual, it was meant as an insult, and was taken so. So it went to court, to second level of jurisdiction. The court was beautifull:

                      The German Constitution (Grundgesetz) forbids discrimination, article 3, part 3 (Art. 3, Abs. 3 GG) states, noone may be favored or discriminated for the reason of his/her parentage/descent, race, language, homeland, religion, religious and political opinion...
                      Eventually this includes sexual orientation, i.e. homosexuality.
                      So, even if somebody says to someone else: "Sir, you are a homosexual, Sir." and does so with the intent of an insult. And the other person takes it as an insult, it provides no objective insult. It cannot provide one, because the Constitution says, sexual orientation is no matter of discrimination of insult, like religion, race, etc., (as long it leads to consensual practice with matures).
                      It would have been insulting, if the LEO was called less neutral terms of that particular sexual orientation, but this wasn't the case.

                      My impression is, the real point is homosexuality and homosexuals. But after it became more difficult to call them Idunnowhat, without being called hater, homophobic etc. people try less direct ways like refusing equal rights in marriage, adoption, etc.

                      Disclaimer:
                      In Germany the tax law favors the man/woman-marriage, so it's a long way to equality, anyway.
