Punches lead to teacher's suspension

PUTRAJAYA: The male teacher alleged to have punched Lim Nien Nie, 1 (http://www.nst.com.my/Current_News/NST/Friday/National/20070713075948/Article/index_html#)3, on Monday was suspended the next day.
Deputy Education Minister Datuk Noh Omar said it was wrong for the teacher at Sekolah Menengah Raja Lumu, Pandamaran, to have hit the student even if he had been provoked.

"Whatever it is, the teacher has breached regulation 43(1) of the civil servantsí misconduct and disciplinary procedure. We will wait for the outcome of police investigations before taking action.

"In the meantime, state and district education officers are also carrying out separate investigations," he told Nien Nieís parents at his office yesterday.

The Remove Class student was punched after she uttered a vulgar word at the teacher when the class was in session.
Her father Lim Kim Chung, 41, sent her to the Tengku Ampuan Rahimah Hospital after the 4.30 (http://www.nst.com.my/Current_News/NST/Friday/National/20070713075948/Article/index_html#)pm incident.

He also lodged a police report.

Noh told Kim Chung that he could also file a suit against the teacher.

"We will not defend the teacher unless, of course, he can show proof that he did not go overboard in his actions."

Noh was also disappointed with the attitude of the schoolís headmistress who had taken the matter lightly when it was brought to her attention.

"I was told by the parents that they waited for two hours but did not get to see her as she was busy.

"I told her that she should have called for a meeting of the school disciplinary committee immediately, as this concerns members of the public."

Noh also lambasted the DAP for interfering in the matter by instructing Kim Chung to submit a memorandum to Noh.

He declined to accept the document, saying that political parties should not politicise such issues.

The DAP arranged the press conference on Wednesday, where Nien Nie revealed the incident.

Noh advised Nien Nie, who has been staying away from school, to return to class.

"Donít be scared. Go back and study as usual. We will take care of you," Nien Nie who is still suffering from pain on the left of her face, was told .

Nien Nieís mother Ng Lee Yong said her daughter had made a mistake in uttering the vulgar word, but this had not warranted the assault.

"I have spoken to her about what transpired before she was punched and I know she was very angry."

Ng also clarified that Nien Nie had mentioned the words under her breath but that the teacher had heard them.

"I know the words were not very pleasant, but that does not give him the right to punch her."

Ng said her daughter was traumatised by the incident and was now afraid to go to school.

Man Sentenced to Year in Jail on Charge of Choking Boy

MARSHFIELD, Wis. (AP) -- A Marshfield man has sentenced to a year in jail on charges that he hit and choked a 12-year-old boy.

47-year-old Steven Eberhart was also ordered yesterday to undergo counseling in connection with the felony child-abuse charge.

According to the criminal complaint, Eberhart hit and choked the boy for talking back to him.

Prosecutors say an officer tried to arrest him but Eberhart fought with him, challenging the officer to use a stun gun.
