What would you do in this situation?

So there's this guy who sold a car to my friend saying it was a clean title, and it ended up actually being a salvaged title. We tried to get the money back but it turns out he spent it all already. So we tell him that we'll give him a few weeks to get the money together and he stops answering phone calls and other crap. It's okay though, we know where he lives and such so it's not a big deal. But now he's apparently joined a gang or something.

Long story short: I ended up saying that he liked gay porn and avril lavinge in my signature on another website, he gets pissed, they hassle me about it, then today he comes up and in a rage of sheer stupidity which was EXTREMELY funny threatened that he was going to kill me if I don't remove it from my sig. So I'm laughing in my car as it's green light and he's all the way like 100ft behind me and people are honking at him.

Anyhow, how should I go about this? I'm thinking we bring him to small claims court about the car thing and then a few days later after we get our money back, I'll get him and his little gang arrested for threatening my life. Oh yeah they were stupid enough to send me the threat in a PM. Real smart.

But they're not really a gang, they're seriously, 10 guys who got together and basiclaly agreed that it would be cool to get together and form a gang.

Should I do the court thing or "sell my debt." If you know what that is... or what would you do?

In Australia we have a thing called a REVS check, where you either call up or use the net, and you just provide the rego and VIN of the car, and you can find out whether it's an encumbered vehicle, was ever written off or stolen etc. No-one should EVER buy a car without doing this first, and I'm sure there's an equivalent wherever you are.

Anyway, after reading your post, I can't believe you're old enough to drive haha!

P.P.S. To answer your question (sorry!) I would call consumer affairs and find out what my rights are.

True, hes committing slander, but I believe that in threatening to kill him, the other guy has committed some form of assault.

In california threating someones life is a terroristic threat, I just went ot court on the 19th with this charge, I came very close to prison time VERY close.

Anyway, if you are found guilty its strike and a mim of 5 years, I was offered felony probation and up to one year local time. Thank god it never came to that.

Anyway here are the guidlines for terroristic threats

In California, under Penal Code Section 422, a criminal threat has five elements:

1. the accused willfully threatened to commit the crime that will result in death or great bodily injury; and
2. the accused made the threat with the specific intent that it be taken as a threat; and
3. the threat is so unequivocal, unconditional, immediate, and specific as to convey a gravity of purpose and the immediate prospect of execution; and
4. the threat actually caused sustained fear in the victim; and
5. the sustained fear was reasonable.

It's not libel when it's true. He does like Avril Lavinge, I've seen the CD case... and he hangs out with guys all the time, so it's only good logic that he likes gay porn. At this point it's gossip.
