IANAL, but It does not explicitly indemnify the venue. It should specifically mention them and give the address they are located out. The school probably the most important entity to protect with a waiver like this, because they are usually the ones with the most to lose.
I would probably omit the rules as well, because as it doesn't say what the penalty is for breaking the rules. It's not like bullshido is a sanctioning body, the rules have always been suggestions. Plus, accidents happen. I have personally worked a laceration from an unintentional head butt, but that didn't mean the guy who did it received written notice that he breeched his contract.
Also, we don't want a list of rules like this because then "bullshidoka" will just say that we are hiding behind our rules.
You can't list out all the other participants who have signed. That means instead of collecting N signatures you have to collect N^2 signatures. Plus when somebody new shows up to the TD you have to have everyone that is already there go back and sign his waiver. Not practical.
This document shouldn't just provide legal indemnification, but a strong disclosure to warn them about what might possibly happen. Here is the waiver I use, I especially like the part where it says "INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES".
The undersigned acknowledges and fully understands that he/she will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions or negligence but the actions, inactions or negligence of others, the rules of play, or the condition of the premises or of any equipment used. Further, that there may be other risks not known to us or not reasonably foreseeable at this time.
I accept all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability or death.
I HEREBY RELEASE, WAIVE,DISCHARGE AND COVENANT not to sue Martial Arts International, their respective administrators, directors, agents, coaches, and other employees of the organization, other participants, sponsoring agencies, sponsors, owners and leasers of premises used to conduct the event, all of which are hereinafter referred to as "releasees"... from any and all liability to the undersigned, his or her heirs and next of kin for any and all claims, demands, losses or damages on account of injury including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise,
I/We HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. I'm going to be training with some people outside of class and I was just thinking I wanted some sort of waiver so I posted up something I thought would be suitable. I framed it from the perspective of a throwdown because I thought that would be easy to discuss (and easy for me to adapt). I'm not trying to push a 'Bullshido' waiver just thought it would make easy discussion.
I did a quick search yesterday for waivers on the site but there didn't seem to be any, I think it would be great if there were a few templates people could use.
I know most clubs have a waiver.
Yeah, thats pretty true. My intention was that you were protected against being sued as long as you followed the rules. If you want to use eyegouges etc feel free too, but don't expect someone not to thoroughly prosecute you under the law lol.
