I don't get why it didn't occur to Sirc to just check with someone qualified. Someone, anyone, but people on the internet. If you're a student go to a student advisor, a legal aid office, the courthouse, city hall, anything, and you'll probably get a nod in the right direction. Small claims is meant for people without much legal training, even just going to small claims and asking a few questions will get you more results than asking on Bullshido and being labelled the "HOW DO LAWSUIT" guy.
