Yes I am. Actually, according to California law, kicking someone with ANY sort of shoe is assault with a deadly weapon. So I could clock you in the head with my heal, barefoot and it would be simple battery, but if I put on a pair of sandals and scrape your shin, that's assault with a deadly weapon. But I shouldn't get started on California law, it just makes me angry.
