Judge: Martial arts expert charged with rape is not a violent sexual predator

SUNBURY -- A Northumberland County judge Wednesday determined a Milton man who allegedly raped a teenage boy in his Milton home and was in possession of child pornography is not a sexually violent predator, according to published reports.

President Judge Robert B. Sacavage ruled the state did not demonstrate that Mark Densberger, 47, of Milton, is a sexually violent predator. Sacavage did say, however, that Densberger is a sex offender and his actions damaged the psyche of his victims, reports said.

Densberger has pleaded no contest to sex-related offenses in a deal where prosecutors dropped the charges of rape, among other charges.

Police charged Densberger in May 2004 after obtaining a written statement from a victim who was allegedly routinely raped in the home as a means of punishment. They also discovered child pornography at the North Front Street home after serving a search warrant. Police said the tapes they found included images of teens having sex, as well as tapes containing images of Densberger having sex with juvenile boys.

In June 2004, Densberger was caught attempting to flea to Canada after he had been released on $145,000 bail. Densberger and a 17-year-old juvenile were stopped at the New York/Canada border when Canadian authorities became suspicious and noticed a large amount of undeclared cash in one of the vehicles. Court paperwork was also found at that time.

Densberger is an internationally known martial art expert in the field of SOMBO and a former employee of the Federal Bureau of Prisons.

So how does a guy who REGULARLY rapes a teenage boy, has child porn, and has porn tapes with HIMSELF AND TEENAGE BOYS, NOT a sexual predator?

Maybe they mean Statutary Rape. I don't know Canadian law, but rape is usually defined as "sex without consent." Since his boyfriend is only seventeen, probably below "the age of consent", it becomes rape by technicality, even if he wanted it. That would explain why he's not a "violent" sexual predator. Just a gay man who should know better than to screw seventeen year-olds.

'sexually violent preditor sounds like an status that results in additional time. It may be based on some distinction involving 'aggrevating factors' such as use of a weapon, actual physical harm as verses the implied threat of harm ect. As far as I'm concerned if he forced himself on the kid, morally he's a sexually violent preditor regardless of what the law says. Why are all the Sombo guys I know twisted?
