    I'd say spitting on somebody is a civil battery and at least a misdemeanor criminal assault (or criminal battery) everywhere in the U.S. Problem is, under the law that doesnt necessarily justify using physical force in response, if no other physical force is threatened or reasonably anticipated. The good news is that I'd be surprised if anyone were ever prosecuted for returning a single blow under those circumstances.

    In Idaho, "battery" equal actual touching, "assault" is for example taking a swing and missing.

    I agree about the low chances of prosecution for hitting a guy once who spit on you. I'd be willing to take my chances with a jury on that one...

    Doofa is actually right for once.

    Spitting BY ITSELF is considered assault in a lot of jurisdictions, especially against officers.

    And, the spit doesn't actually have to land on you to count as assault.

    While I was a grand juror, there was an ADDED charge of assault on an officer due to spitting, post arrest, and it never touched him.

    Most of you guys are way more level headed than I am, if someone is launching saliva missiles at me I would find it difficult to not stomp the asswipes nuts into pudding. But I tend to overreact.

    The law is vague. I've asked policemen about self defence laws and they say, "just call the police." Not very helpful. The 'law' generally seems to come down on the side of whoever looks worse at the end of the fight. Most things don't even go to court, you just have to spend hours negotiating 'compensation' in a police station with someone who is hoping for a big pay day off a rich foreigner. That's the main reason I tried to avoid punches to the face.
