Blimey. I didn't read this thread until now...
Just a thought. Is the OP the whole story? If it is, then fair enough, although I noticed that the story changed from 'he killed him with one punch' to "he beat him to death with his bare hands". This probably also means kicks, stamps etc, an altogether bloodier scenario than that likely from a single punch...

Who knows? It might be that there was a personal history of antagonism between the 2 men and it got out of hand.
This is not intended to be provocative, it's just that the CNN report was, er, 'sparse'. Just an unsupported piece of video.

Well you are more than welcome to add new developments that happened.
I guess a one punch scenario can kill, it is just highly unlikely, people are much harder to kill. I think he continued to strike well after the man was incapacitated, that is why he could be facing charges, and that is why it is an interesting article. If he used a gun or some weapon other than his hands, something that caused instant death, he could use the diminished capacity defense like the lawyer and i suggested, however it will be harder the longer the attack lasted. We all deaply simpethy with the father (not the hysterical troll bate poster, the father from the OP), so inspite the fact he is clearly in the wrong here from the dry law point of view, we all want to see a bend in the rules for his sake.

The father, whose name has not been released because he has not been charged with a crime, heard his daughter's screams and ran to a secluded area, where he "removed Flores from on top of his child and, in the process, inflicted several blows to the man's head and neck area," McMinn said.In court papers, Harmon said evidence found at the scene appeared to substantiate the father's account.
"The man's pants and underwear were down and his genitals were exposed," Harmon said. "In addition, all of the physical evidence and several detailed witness statements corroborated the father's statement."
