Why is the kid under any special duty to retreat as he walks along the street? If an old guy pulled up to me in a car and wanted to know what I was doing on the sidewalk, I'd tell him to **** himself, it's a free country.

edit: It's interesting that the "old" person here is 28. Not exactly clint eastwood in grand torinio.

I'm also wondering how the fact that it happened in a gated community, between two residents might change the various obligations to retreat.

A resident and a visitor, apparently. The kid was visiting his father's girlfriend's house.

He may get his comeuppance but I'd be surprised if he gets the death penalty for a spur of the moment shooting. Maybe. Florida does like to execute folks.

The entire gated community is private, though, so it has to change notions of who came onto whose property a bit... it makes the guy look more racist to me, as it supports him jumping to the conclusion "Young black guy = obvious interloper"
