Final Update on Legal Proceedings from Don Cunningham...


I heard from my attorney last week. Apparently Rod's lawyer has finally convinced His Royal Soke-ness that there is no hope of ever winning any judgment for his legal expenses in the harrassment/forgery complaint. Therefore, Rod has given up his settlement demand to restrict me from publishing the court records about his lies, behavior, and his past criminal record. (I would never agree to this even if he had a chance of getting any of his expenses from me.) They are now willing to drop his motion after we sign some papers agreeing not to pursue any more legal actions against each other. I never had any real expectations of ever collecting any of the $50,000 award, so it is basically another win for the good guys.

It has cost me a lot of money and time since Rod filed his original libel complaint against me. On the other hand, I have proven in court that everything disclosed about Rod's lack of authentic martial arts credentials and his criminal activities was the complete and honest truth. Even the denials he has made have been shown to be false. Further, I've exposed Rod's use of dishonest and illegal intimidation tactics. His threats and posturing are nothing more than hot air and have no more substance than his Juko-Kai rank certificates and sokeship awards.

Although Rod lied about me and the statements to get Juko-Kai members to donate $10,000, this entire incident has cost him far more. The estimate of his legal expenses in filing the frivilous complaint against me is no more than a few thousand, certainly far less than he told Juko-Kai members. Yet answering the harrassment/forgery complaints has probably far exceeded any profit he made. The financial cost aside, his Juko-Kai organization is now in complete shambles, leaving Rod with only a handful of hardcore fanatics to worship him. In sworn testimony, Rod's wife described how Rod now depends on the income she brings into the household from her job. It is truly pathetic.

With this said, I now hope to put all of this behind me and move on to more important things.
